1. Who we are and what this is

Welcome to Vari — a hydration tracking app and website designed to help individuals and households build sustainable hydration habits. These Terms of Use (the "Terms" or "Agreement") are a legal agreement between you and WebMobi (Mendios Technologies) (referred to as "Vari", "we", "us", or "our"), the operator of:

  • the website at https://getvari.app (the "Website");
  • the Vari mobile application on iOS (and Android when available) (the "App"); and
  • any features, tools, content, and services we offer in connection with the Website or App (together, the "Services").

By accessing the Website, creating an account, downloading the App, or using any Service, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1.1 Who can use Vari

  • You must be at least 13 years old to use Vari. If you are between 13 and 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
  • Children under 13 must not create a Vari account directly. A parent or legal guardian may add a profile for a child under 13 within the Family tier household (see §8 Family Tier) — that profile is an entry in the guardian's account, not an independent account.
  • You must be legally capable of entering into a binding contract under the laws of your country of residence.
  • You must not be barred from using Vari or similar services under any applicable law.

1.2 Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will:

  • post the revised Terms with a new "Last updated" date;
  • if you have an account, notify you via email at the address on file, and/or via an in-app notification, at least 14 days before the change takes effect where required by law; and
  • for non-material changes (typos, reformatting, clarification), the revised version takes effect as soon as it is posted.

Continued use of the Services after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, you may stop using the Services and close your account.

1.3 Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your data, including health-related information.

By using Vari, you agree to the terms of the Privacy Policy.

If there is any conflict between these Terms and the Privacy Policy, these Terms shall prevail with respect to your use of the Services, and the Privacy Policy shall govern data handling practices.


2. Your account

2.1 Registration

You may use parts of the Website without an account (for example, public calculator pages and blog content). To use the App, save results to your profile, or subscribe to Vari+ / Vari+ Family, you must create a Vari account ("Account") by providing:

  • an email address; and/or
  • a verified identity through a supported third-party sign-in (currently Sign in with Apple or Google).

We use a one-time-passcode (OTP) flow sent to your email or verify through the third-party identity provider. You are responsible for keeping your email account and any linked identity-provider account secure; activity that happens under your Account is treated as your activity.

2.2 Accurate information

You agree to:

  • provide truthful, accurate, current information when you register or when you save calculator results;
  • keep your information updated if it changes (for example, age or weight affects hydration recommendations);
  • not impersonate another person or misrepresent your affiliation with any person or entity;
  • not create more than one Account per person, except with our written permission.

2.3 Suspension or termination

We reserve the right, at our sole discretion, to suspend or terminate your Account with or without notice if we reasonably believe you have:

  • violated these Terms or any applicable law;
  • abused, harassed, or threatened any Vari user, staff member, or third party;
  • submitted fraudulent payment details or reversed a legitimate charge;
  • used the Services to harm the integrity, security, or availability of our systems;
  • engaged in conduct that could subject Vari to legal liability.

Where we reasonably can, we will notify you and give you an opportunity to cure the violation. In serious cases, we may terminate immediately.

On termination, you lose access to your Account and saved data. We may retain certain data as described in the Privacy Policy.


3. The Services

3.1 What the Services do

Vari provides:

  • Hydration calculators that estimate a daily water target based on inputs you provide (age, weight, activity, climate, etc.).
  • The Vari App which tracks drink logs, sends smart reminders, calculates a daily "Flow Score," and syncs with Apple Health (and, in future releases, Google Health Connect).
  • Saved plans delivered by email and optionally stored on your Account.
  • Family features (Vari+ Family tier — coming in a future release) for shared household hydration tracking and member invitations.
  • Weekly newsletter and drip emails with hydration tips (optional subscription, unsubscribe any time).

The exact feature set available to you depends on your subscription tier (see §4 Subscriptions). We may add, change, or remove features at any time.

3.2 Not medical advice

Vari is not a medical device and is not a substitute for professional medical advice, diagnosis, or treatment. Specifically:

  • Daily water targets generated by our calculators are general guidance based on peer-reviewed hydration research, not medical prescriptions.
  • Our sick-day rehydration calculator (where offered) provides general oral rehydration guidance and is not a substitute for emergency medical care. If you or a family member shows signs of severe dehydration (persistent vomiting, inability to keep fluids down, lethargy in a child, reduced urine output, confusion), stop using the tool and contact a medical professional or emergency services immediately.
  • If you have any medical condition — including kidney disease, heart disease, diabetes, electrolyte imbalance, pregnancy, or a history of over-hydration — consult your doctor before relying on Vari's recommendations.
  • Do not increase or decrease your fluid intake substantially based on Vari without first discussing with your healthcare provider.

You acknowledge that you use the Services at your own risk and agree not to rely solely on Vari for any health-related decisions.

3.3 Availability

We do our best to keep the Services available 24/7, but we do not guarantee uninterrupted access. We may perform maintenance, experience outages, or restrict access from specific regions.

3.4 Changes to the Services

We may add, modify, or remove features of the Services at any time, including free and paid features.

Where changes materially affect paid features, we will provide reasonable notice and, where required by law, allow you to cancel your subscription before such changes take effect.

We are not liable for any modification, suspension, or discontinuation of the Services.


4. Subscriptions

4.1 Tiers

Pricing is displayed at checkout in your local currency (converted at App Store rate). We may change prices at any time. Existing paid subscribers will be notified at least 30 days before a price increase and may cancel before the increase takes effect.

4.2 Free trial

Paid subscriptions include a 7-day free trial for first-time subscribers. During the trial:

  • you have full access to paid features;
  • you can cancel at any time before the trial ends with no charge;
  • we will email you approximately 2 days before the trial ends as a reminder;
  • if you do not cancel, your first billing period begins automatically at the end of the trial.

Second trials for the same Apple ID or Vari account are generally not available.

4.3 Auto-renewal

Subscriptions auto-renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before renewal.

  • If you subscribed through the App Store, your Apple ID is charged and you manage renewal through Settings → [Your Name] → Subscriptions.
  • If you subscribed through Google Play Store, your Google account is charged and you manage renewal through the Play Store → Subscriptions.
  • If you subscribed through the web (Razorpay or PayPal — when these payment methods become live), your card or account is charged and you manage renewal through your Vari Account Settings.

4.4 Refunds

Refunds for purchases made through the App Store or Play Store are handled by Apple or Google under their respective policies. Vari cannot issue refunds for these purchases directly — you must request them through Apple or Google.

For web subscriptions (when enabled):

  • You may cancel at any time. Cancellation takes effect at the end of the current billing period — you keep access until then.
  • Refund eligibility for the remaining period is at Vari's discretion and subject to applicable consumer protection law in your jurisdiction.

Where required by law, we honour statutory rights of withdrawal within the window your jurisdiction prescribes.

4.5 Taxes

Prices displayed may exclude applicable taxes such as VAT, GST, or sales tax. The final amount charged may include such taxes based on your billing location and the platform through which you subscribe.

For subscriptions purchased through app stores, taxes are determined and applied by the platform provider.


5. Your licence to use the Services

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Services for your personal, non-commercial use, subject to these Terms. You may not:

  • sell, rent, lease, or sublicense any part of the Services;
  • copy, modify, or create derivative works of the Services, except as expressly permitted;
  • reverse engineer, decompile, or attempt to extract source code, except to the extent required by applicable law;
  • use the Services to build a competing product or service;
  • scrape, crawl, or harvest any content or data from the Services except by means we explicitly authorise (public RSS feeds, documented APIs, etc.);
  • remove any copyright or proprietary notices;
  • use the Services in a way that infringes any third-party right or violates any law;
  • attempt to access accounts, data, or systems that do not belong to you.

We reserve all rights not expressly granted.


6. Content and acceptable use

6.1 Your content

You may add content to Vari: hydration logs, notes, custom goals, family member profiles you create (in the Family tier), tool results you save. We call this "User Content."

You retain ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, process, display, and transmit that content solely to operate and improve the Services. This licence ends when you delete the content or close your Account, except:

  • we may retain anonymised, aggregated data (see Privacy Policy);
  • we may retain backups for a reasonable period;
  • we may retain content as required by law or to resolve disputes.

We may also use aggregated, anonymised, or de-identified data derived from User Content for analytics, research, and product improvement purposes. Such data will not identify you personally.

6.2 Prohibited content

You may not submit User Content that:

  • is illegal, obscene, pornographic, defamatory, harassing, hateful, threatening, or promotes discrimination;
  • infringes intellectual property or privacy rights of any person;
  • includes malware, viruses, or harmful code;
  • impersonates another person or falsifies your identity;
  • is knowingly false or misleading;
  • violates any applicable law.

We reserve the right (but have no obligation) to review, remove, or modify any User Content at our discretion.

6.3 Feedback

If you send us suggestions, ideas, or feedback, we may use them without obligation or compensation to you. We will not publicly identify you as the source without your consent.


7. Apple Health and Google Health Connect integration

Vari can optionally integrate with Apple Health (HealthKit) on iOS and Google Health Connect on Android. When you enable the integration:

  • Vari reads only the specific data types you explicitly grant permission for (e.g. water intake, body weight, active energy, heart rate).
  • Vari writes only your hydration logs back (if you grant write access).
  • We do not use HealthKit or Health Connect data for advertising or marketing.
  • We do not share HealthKit or Health Connect data with any third party except as required to operate the feature you requested and as permitted by Apple's and Google's developer programs.
  • We do not sell HealthKit or Health Connect data under any circumstances.
  • You can revoke access at any time in the Health app (iOS) or Health Connect settings (Android), and any Vari features that depend on the data will stop working accordingly.

8. Vari+ Family tier

This section applies once the Vari+ Family tier is live. The language is drafted here so it is ready when we flip the switch.

8.1 The household model

The Vari+ Family tier enables one "Household Owner" (the account holder who purchased the subscription) to manage a household with up to 6 "Members." Each Member has a profile that includes:

  • a display name;
  • an age or age band;
  • optional weight, height, and goal targets;
  • hydration logs and statistics.

Members can be added in two ways:

  • With their own Vari account. The Owner sends an invite to the Member's email. The Member accepts, creates their own Vari account, and is linked to the household. The Member's data is their own; the Owner can see summary information (total daily intake, whether goal is met) but not the Member's granular logs unless the Member chooses to share.
  • Without an email (for children, elderly members, or anyone without their own device). The Owner creates a profile that belongs to the Owner's account. The Owner logs drinks on behalf of that profile. Data in this profile relates to the individual Member but is managed and controlled by the parent or legal guardian through the Owner's Account.

8.2 Parental responsibility

If you add a child (under 18) as a Family Member without an email:

  • You represent that you are the child's parent or legal guardian and that you consent to Vari processing the child's information for the purpose of household hydration tracking.
  • You are responsible for the accuracy of the child's information (age, weight, medical conditions).
  • Vari does not collect additional data directly from the child. Logs, notes, and settings are all managed by you.
  • You can delete the child's profile at any time from Settings → Family → Remove Member. Deletion permanently removes the profile and its logs from your Account.

If you add a child as a Family Member with their own email (13-18), both you and the child must agree to these Terms, and the child will have their own Account subject to the same age-gate rules in §1.1.

8.3 Leaving a household

A Family Member can leave the household at any time. Their Account remains; they lose the paid entitlement that came from being in the household. Their data remains on their Account.

If the Household Owner cancels the Vari+ Family subscription, Members lose the paid entitlement at the end of the billing period. Member data remains intact.


9. AI-generated content

This section applies once Vari's AI-powered coaching features are live.

Some Vari features may use third-party artificial-intelligence services (such as OpenAI's API) to:

  • generate personalised hydration insights;
  • answer natural-language questions in a chat interface;
  • explain trends in your data.

When you use these features:

  • a subset of your data (inputs you provide and a summary of your recent logs) is sent to the AI provider for processing;
  • the AI provider processes the data solely to return a response to Vari and does not use your data to train its general models (per the provider's API terms as of the effective date of these Terms);
  • AI-generated output is provided for informational and motivational purposes only — it is not medical advice (see §3.2);
  • outputs may be inaccurate, incomplete, or outdated; do not rely on them for decisions with material health consequences.

You may opt out of AI-powered features in Settings. Core Vari features (logging, reminders, calculators) continue to work without AI.


10. Third-party services

Vari integrates with or depends on third-party services, including (non-exhaustive):

  • Apple and Google for App Store / Play Store billing, push notifications, and Sign-In;
  • Supabase for database and authentication infrastructure;
  • Amazon Web Services (Simple Email Service) for transactional email;
  • RevenueCat for subscription management;
  • Razorpay and PayPal for web payments (when enabled);
  • Sentry for crash reporting;
  • Mixpanel for product analytics;
  • OpenAI (planned) for AI features.

Your use of these third-party services is governed by their own terms. We are not responsible for the actions, content, or policies of third-party services.

Links to third-party websites or apps on Vari are provided for convenience. We do not endorse them and we are not responsible for their content or policies.


11. Intellectual property

The Services, including all software, content, graphics, text, trademarks, logos, and designs (except your User Content), are owned by Vari or our licensors and are protected by intellectual-property laws. You may not use any of our trademarks without our prior written permission.

The name "Vari" and the Vari logo are trademarks (or pending trademarks) of WebMobi (Mendios Technologies). Other trademarks referenced on the Website or App (such as Apple, Google, Razorpay, PayPal, OpenAI) belong to their respective owners.


12. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Vari, its officers, directors, employees, agents, and licensors from and against any claim, demand, loss, damage, cost, or liability (including reasonable legal fees) arising out of or related to:

  • your use or misuse of the Services;
  • your User Content;
  • your violation of these Terms or any applicable law;
  • your violation of any third-party right.

We will promptly notify you of any such claim and, where we reasonably can, give you control of the defence (at your expense) using counsel reasonably acceptable to us.


13. Warranties and disclaimers

The Services are provided "as is" and "as available," without any warranty of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that:

  • the Services will meet your specific requirements;
  • the Services will be uninterrupted, timely, secure, or error-free;
  • any calculation, recommendation, or AI-generated output is accurate or will produce any particular result;
  • any data shown (including HealthKit / Health Connect data relayed by the device operating system) is accurate.

Some jurisdictions do not allow the exclusion of implied warranties; in those jurisdictions, the exclusions apply to the maximum extent permitted by law.


14. Limitation of liability

To the maximum extent permitted by law, Vari and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including but not limited to lost profits, lost data, business interruption, or personal injury) arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.

To the extent we are liable for any direct damages, our total aggregate liability under these Terms is limited to the amount you paid Vari in the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow the limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.


15. Termination

You can close your Account at any time from Settings → Account → Delete Account, or by emailing support@getvari.app.

We can terminate your access as described in §2.3. Upon termination:

  • your right to use the Services ends immediately;
  • sections of these Terms that by their nature should survive (for example, Intellectual Property, Indemnification, Warranties, Limitation of Liability, Governing Law) survive termination.

16. Dispute resolution and governing law

16.1 Governing law

These Terms are governed by applicable laws based on your country of residence.

For users based in India, Indian law shall apply.

16.2 Dispute resolution

Before initiating any formal proceeding, you agree to contact us in good faith at support@getvari.app to attempt to resolve the dispute.

If we cannot resolve the dispute within 30 days, the parties may pursue resolution through courts or arbitration as permitted by applicable law.

Nothing in these Terms limits your rights under applicable consumer protection laws in your jurisdiction.

16.3 Grievance Officer

In accordance with the Information Technology Act 2000 and related rules applicable to Indian users, our Grievance Officer is:

17. Miscellaneous

17.1 Entire agreement

These Terms, together with the Privacy Policy and any feature-specific terms we point you to, constitute the entire agreement between you and Vari regarding your use of the Services.

17.2 Severability

If any provision is held unenforceable, the remaining provisions continue in full force and effect; the unenforceable provision will be modified to the minimum extent needed to make it enforceable.

17.3 No waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

17.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms freely in connection with a merger, acquisition, or sale of substantially all our assets.

17.5 Notices

We may give notice to you by email to the address associated with your Account, by in-app notification, or by posting on the Website. You can give notice to us by email at support@getvari.app or by post at either of our offices (US or India) listed in §1.

17.6 Force Majeure

Vari shall not be liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to:

  • internet or network failures;
  • cloud service or infrastructure outages;
  • failures of third-party services (including payment providers or platform providers);
  • natural disasters, acts of government, or force majeure events.

During such events, the availability of the Services may be affected.
